Everything You Need to Know About Hiring a Commercial Litigator in Arizona

When you are litigating a commercial case, it can seem like there is so much legal minutiae and filing deadlines that it's impossible to keep track of everything.

That's why I created this page on my website - so that you can have a resource to get you started, and to answer the basic questions about commercial litigation.

However, as an attorney with over forty years of experience in Arizona law, and countless commercial trials under my belt, I must advise you to eventually seek legal help. There is only so much you can, and should do, on your own.

What does “commercial litigation” mean?

Commercial litigation means any lawsuit, arbitration, or administrative proceeding in any tribunal (i.e. court, agency, or private) involving real estate or business disputes.

I have a long history of commercial litigation. In my forty years of experience in Arizona courts, I have represented clients in business ownership disputes, construction claims and disputes, contract interpretation or enforcement, professional liability and malpractice of accountants, architects and lawyers, patent and trademark infringement and enforcement and general real estate related litigation.

When does it become necessary to litigate?

In my view, a business enters into the court system only as a last resort. A reasonable compromise of any business dispute should always be attempted first, and if not, a mediation with a professional mediator. 

Litigation in any forum is expensive, distracts business owners from time spent managing their business operations, can take a very long time, and puts the owner at risk of an unfavorable decision.

It is a decision best made with an experienced professional.

What types of businesses do you litigate for?

I litigate for all types of clients. Odds are good that, regardless of how your business operates, I can help. Over my forty years of being a litigator I have represented all types of businesses to assist them in resolving their disputes.

How much does it cost to hire you as a commercial litigator
I bill by the hour but require an advance deposit of an amount that considers the amount in dispute and the status of the case.  Attorneys generally don’t do credit checks on clients and rely on advance deposits to ensure timely payment avoiding a dispute with the client.
I don't live in Tempe, Arizona... Will that be a problem?

Not in today’s world. I have represented clients all over Arizona and in Southern California, Nevada and in Utah. I have also represented clients with Federal agencies in Washington DC.

Thankfully, communications and filings these days are electronic and there are document delivery systems and overnight carriers like FedEx when necessary. It's a vastly different world than it was when I started.
